During the mediation we will draw up a divorce settlement agreement ( or a draft version for further legal scrutiny ) together.
A divorce settlement agreement is a legally binding contract between divorcing spouses that outlines how they will divide their assets, debts, and other financial matters upon divorce. This agreement typically covers:
Division of Assets: How the couple's property, including homes, vehicles, and investments, will be divided.
Debt Allocation: Who will be responsible for paying off shared debts, such as credit cards or mortgages.
Spousal Maintenance: Whether one spouse will pay the other ongoing financial support.
Child Maintenance: How the costs of raising children will be shared.
Parental Responsibilities: Arrangements for custody, visitation, and decision-making regarding the children.
A divorce settlement agreement can be reached purely through mediation. Once the agreement has been reached I will help you navigate the confusing admin of having the agreement made an order of the court and finalising the divorce. It will involve filing papers with the court, a summons and a mandatory court appearance. Mediation expedites this process as the agreement is uncontested and hearing is typically a brief formality.
